Heard learned counsel for the petitioner and

learned A.P.P. for the State, Mr. Chandra Bhushan Prasad.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 137(2) and 140(3)of the BNS, 2023.

The Superintendent of Police, Rural Patna along with the SHO and the Investigating Officer of the case in compliance of the order dated 14.07.2026 are present in the Court.

The Superintendent of Police, Rural Patna, at the outset, submits that the victim has been recovered and her statement has been recorded under Section 183 of the BNSS, wherein she has not supported the case of the prosecution.

petitioner, at this stage, submits that petitioner is father of Deepak with whom the victim had eloped.

Learned A.P.P. for the State fairly submits that victim has not supported the case of prosecution in her statement recorded under Section 183 of the BNSS and has refused for her medical examination, but then based on her certificate issued by the principal based on her admission taken in the school, the victim is a minor aged about 16 years, on which the learned counsel appearing on behalf of the petitioner submits that based on certificate issued by the principal of school it cannot be construed that victim is a minor, it is further submitted that victim is not a minor rather is a major and thus had eloped with Deepak.

Considering the submissions made by learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mokama P.S. Case No. 465 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
