Heard the learned Advocate for the petitioners and the

learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in connection with Daudpur P.S. Case No. 100 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 351(3) r/w Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The allegation against the petitioners is of causing assault upon the informant and his son by means of iron rod and lathi danda , due to which they have sustained serious injuries. Besides, there is allegation against other accused persons of causing assault and snatching of valuables.

Learned Advocate for the petitioners submitted that the injuries which are allegedly attributed to the petitioners, on medical examination, reported to be simple in nature. Moreover, the alleged occurrence took place on 15.03.2026, whereas the present FIR came to be instituted after a delay of three days, i.e. on 18.03.2026, and as such, the exaggeration and false implication of the petitioners cannot be ruled out in the premise of prior animosity. The petitioners are men of fair antecedent and they undertake that they will fully co-operate in the proceeding of the Court.

On the other hand, learned Advocate for the State opposed the pre-arrest bail application.

Regard being had to the submissions made on behalf of the parties and considering the delay in lodging of the FIR, besides simple nature of injuries and the fair antecedent, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1^st Class, Saran at Chapra in connection with Daudpur P.S. Case No. 100

of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioners.
