Heard Mr. Mahendra Pratap, learned counsel for the

petitioner and Mrs. Madhuri Lata, learned APP for the State.

Petitioner seeks bail, who is in custody since 27.03.2024, in connection with Sessions Trial No. 625 of 2024 arising out of Vidyapatinagar P.S. Case No. 160 of 2023, F.I.R. dated 09.10.2023 registered for the offences punishable under Sections 447, 341, 323, 307, 379, 302, 34 of the Indian Penal Code.

Allegation against the petitioner is that he has assaulted to the husband of the informant and he died during his treatment.

Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in

the present case. He further submits that the petitioner is in jail custody since 27.03.2024 and the trial is not in progress.

Learned APP for the State, on the other hand, vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R. it appears that there is specific and direct allegation against the petitioner that he has assaulted to the husband of the informant and he has died during his treatment and apart from aforesaid, it appears from the impugned order that the trial is going on and out of nine chargesheeted witnesses, five witnesses have already been examined.

Considering the aforesaid facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 625 of 2024 arising out of Vidyapatinagar P.S. Case No. 160 of 2023 pending in the Court of learned Additional Sessions Judge, Dalsingsarai, Samastipur.

Prayer is refused.

However, the learned Trial court is directed to expedite the trial and conclude the same at the earliest.
