APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Sarai P.S. Case No. 77 of 2026, dated 12.03.2026, registered for the offences punishable under Sections 303(2) of B.N.S.

3. As per the prosecution case, the truck of the informant was found missing after the same was parked by the side of the Go-down. It has further been alleged that in the CCTV footage, the truck was found to be taken away from the place where it was parked.

4. Learned counsel for the petitioner has submitted that FIR has been registered against the unknown person. It has further been submitted that the petitioner was arrested on suspicion and a self-inculpatory statement of the petitioner was

forced to be made while in police custody. It has further been submitted that there is no recovery of any incriminating article upon the confessional statement of the petitioner. It has further been submitted that the petitioner has been made accused subsequently in one another case. It has lastly been submitted that the petitioner is in custody since 15.04.2026, charge sheet has been submitted against him and there is no allegation of tampering.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

7. Considering the facts and circumstances of the case

as well as the period of custody, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur, in connection with Sarai P.S. Case No. 77 of 2026.
