Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 319(2), 318(4), 338, 336(3), 340(2), 112(2), 61(2), 3/5 of BNS and section 10 of Bihar Conduct of Examination Act.

The case of the prosecution is that somebody else was writing examination of constable recruitment on behalf of this petitioner. On the basis of biometric and photograph, it was found that the biometric and photograph did not match with the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the F.I.R., it is clear that the petitioner has arranged impersonator after paying rupees 1 lakh for getting success in the constable examination. Learned counsel for the petitioner has further submitted that from perusal of the entire F.I.R., it is clear that the name of the impersonator is not there in the F.I.R. It has further been submitted that in this case the person who has impersonated the petitioner is equally liable for the offence. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 21.02.2026.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gardanibagh P.S. Case No. 152 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
