Heard Mr. Bipin Kumar, learned Advocate for the

petitioners and learned Additional Public Prosecutor for the State through virtual mode.

The petitioners are apprehending their arrest in connection with Teghra P.S. Case No. 386 of 2025, registered

for the offences punishable under Sections 338/336/340(2)/339/318(4)/3(5) of the BNS.

The allegation against the petitioners and other co-

accused persons is that on the basis of forged and fabricated documents, they purchased a Government land measuring 1 bigha 4 katha 16 dhurs situated at Mauza-Gaura, Tauzi No.2568, Khata No.1981, Khesra No. 8745 situated at Teghra Ward,

Begusarai. It is further alleged that, despite the fact that the land in question is government land earmarked for the construction of a road for the general public, the petitioners purchased the same and got it mutated on the basis of forged and fabricated documents, in collusion with other officials.

4.Learned Advocate for the petitioners submitted that the petitioners had purchased the land in question from one Lalo Prasad Das long back in the year 1999. Thereafter, they applied for mutation before the Circle Officer, Teghra and after due verification of the document, the land was mutated in their names. It is further submitted that, upon coming to know of the dispute, the petitioners also submitted an application before the District Magistrate, Begusarai with an undertaking that, in the event the jamabandi is cancelled, they have no objection thereto and shall vacate the land in question. The petitioners are men of fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.

On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners had purchased the government land and got mutated in collusion with the officials of the State Government.

the learned Advocates for the respective parties and taking note of the undertaking given by the petitioners that in case of cancellation of zamabandi of the land, they shall vacate the land, besides the fair antecedent of the petitioners and also the fact that the land was allegedly purchased in the year 1999, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 386 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
