Heard learned counsel for the petitioner and

learned Additional Public Prosecutor for the State.

The accused/petitioner is named in the FIR and

apprehending his arrest in connection with Nawada Town P.S. Case No.75 of 2026 registered under Sections 318(4), 324(5), 336(3), 336(4), 339, 340(2) and 61(2) of the Bhartiya Nyaya Sanhita, 2023 (in short ‘B.N.S.’).

Allegation against petitioner is to furnish the wrong information for the purpose of mutation of land, where he shown himself as only heirs of his parents, whereas he has five more brothers.

It is submitted by learned counsel appearing for

petitioner that the petitioner only made a request through e-

e-portal of Revenue Department for mutation of 5.25 decimals of land, where no such averment was raised. It is pointed out that said request was not further pressed by petitioner. It is submitted that request was made with knowledge of rest of the brothers and for that reason only none of the brothers came forward to lodge any complaint with informant as the informant, who is the revenue staff. The petitioner claimed clean antecedent.

Learned APP opposed the prayer of bail.

In view of aforesaid factual submissions and by

taking note of fact as the other co-sharers prima facie not appears to lodge complaint before any revenue authorities against petitioner, accordingly, the petitioner, above-named, in the event of his arrest or surrender in the court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No.75 of 2026, subject to the conditions as laid down
