counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 306/34 of the I.P.C.

As per the prosecution case, the petitioner, who had a five-year relationship with the deceased, refused to marry her despite family intervention, due to which on 24.02.2023, she committed suicide by consuming poison.

Learned senior counsel for the petitioner submits that in the present case the F.I.R. itself indicates that the daughter of the informant (deceased) was aged about 21 years and was having a relationship with the petitioner. It further appears that the maternal uncle of the petitioner had also assured the informant that he would get them married. However, subsequently it is stated that since the petitioner

refused from marrying the informant’s daughter, she went under depression and committed suicide on 24.02.2023 by consuming poison. It is further submitted that the petitioner is nowhere responsible for the death of the deceased and merely because the petitioner and the deceased were in a relationship earlier, would not act as a live and proximate link for becoming the cause of death of the deceased. It is the mental state of the deceased herself which has led to her death and the petitioner for quite sometime was also not in touch with the deceased. The petitioner is in custody since 26.01.2026 with no criminal antecedent and the charge sheet has been submitted.

Taking into consideration the facts and circumstances of the case and also considering the fact that there was a consensual relationship between the petitioner and the deceased and the F.I.R. itself indicates that the deceased had committed suicide on account of her depressive state of mind owing to breakup in the relationship with the petitioner, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
