Heard Mr. Rana Baljit Singh, learned counsel for

the petitioner and Mr. Bharat Bhushan, learned A.P.P. for the State.

The petitioner seeks bail, who is in custody since

28.01.2026 in connection with Harnaut P.S. Case No. 33 of 2026, FIR dated 18.01.2026 registered for the offence under Section 309(4) and 317(3) of the Bharatiya Nyay Sanhita, 2023.

According to the prosecution case, the informant, Rohit Kumar, used to work as a Team Leader of Flip cart, Nalanda. On 17th January 2026 at about 8.50 PM, he was present in his office along with his team mates, a person, who had covered his face, entered in the office and robbed Rs. 2,54,950 at gun point. One miscreant was standing at the gate while another was standing outside the gate. After taking money

all three persons fled away on a black Pulsar-Motor Cycle. Apart from the cash, they also took various articles such as a dash board, key board, mouse, Scanner, thermal printer etc. Thereafter first information report was lodged against three unknown persons.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. Petitioner is not named in the FIR and his name transpired during investigation on the basis of confessional statement of co-accused, namely, Raj Babbar Kumar and except the aforesaid, no other cogent material has come during investigation which suggest the involvement of the petitioner in the present occurrence and the petitioner is rotting in judicial custody since 28.01.2026.

Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that on the basis of disclosure made by the petitioner, three mobile phones, a red and black pulsar motorcycle and looted money was recovered from the house of the petitioner and apart from that petitioner carries one criminal antecedent other than the present one.

case, I am not inclined to enlarge the petitioner on bail in connection with Harnaut P.S. Case No. 33 of 2026, pending in the Court of Additional Chief Judicial Magistrate-1st,

Biharsharif, Nalanda.
