the petitioner and learned APP for the State.

The petitioner is apprehending arrest in connection with Complaint Case No. 607 of 2020, Trial No. 1086 of 2025 of the Indian Penal Code which is pending before Learned A.C.J.M.-II, Saran at Chhapra.

Complainant case, in short, is that on 21.02.2020 at

about 12:30 P.M., the complainant was sitting at his fair price shop, and in the meantime, the petitioner along with two unknown persons reached there and started abusing him. It is further alleged that when the complainant protested, the petitioner caught hold of his shirt collar and dashed him on the ground and threatened him by stating that he used to give applications before D.M. and S.D.O. against him and further threatened that he shall file several false F.I.R. against him. It is also alleged that the petitioner demanded Rs. 5000/- per month from the complainant and threatened to close his fair price shop.

Learned Senior Counsel for the petitioner has submitted that during the relevant period, the petitioner was serving in the Food and Consumer Protection Department of the State Government and was discharging official duties relating to supervision and regulation of fair price shops under the Public Distribution System. It has been further submitted that the petitioner has no criminal antecedent and the allegations made against the petitioner is false, baseless and malicious.

Learned counsel for the complainant has opposed the prayer of anticipatory bail and submitted that the petitioner may appear before the Court below and can seek regular bail.

Keeping in view the fact, that the petitioner is a

public servant and in discharge of his duty, certain things happened as alleged, I am inclined to grant the petitioner benefit of anticipatory bail. Let the petitioner above named, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court is connection with Complaint Case No. 607 of 2020, Trial No. 1086 of 2025 of the Indian Penal Code, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarika Suraksha Sanhita, 2023.
