Heard learned counsel for the petitioner and

learned Additional Public Prosecutor for the State.

The accused/petitioner seeks bail in connection

¶13

with Bhojpur Cyber P.S. Case No.11 of 2026 registered for the offences punishable under Sections 318(4) and 319(2) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘B.N.S.’)

and Sections 66(c) and 66(d) of I.T. Act.

The accused/petitioner is not named in the FIR

and is in custody since 06.02.2026.

As per the FIR, the named co-accused persons

were found indulge in cyber fraud, where the bank accounts of innocent peoples were used by named co-accused persons

for illegal transactions.

It is submitted by learned counsel for the petitioner that this petitioner is working as a Sales Executive of Utkarsh Small Finance Bank, Ara. It is submitted that as per profile, this petitioner was under legal obligation to open the bank account of the customers after verification of their documents/credentials. It is also submitted that no allegation regarding opening of bank account on the basis of false documents is available against this petitioner and also to indulge in withdrawal of money or transfer of illegal physical money etc. It is submitted that this petitioner opened the bank account of some customers, who later on found in use for cyber crime for transferring the cheated funds. This petitioner was implicated also on the basis of confessional statement of co-accused persons, in furtherance of which no incriminating material appears recovered/surfaced as to connect this petitioner with the present crime in question. Petitioner claimed clean antecedent.

In view of aforesaid factual submissions and by

taking note of fact as prima facie except suspicion arising out of confessional statement of co-accused nothing appears incriminating against this petitioner, who was the Sales Executive of the Utkarsh Finance Bank and was legally involved in opening the bank account of customers, where petitioner remains in custody since 06.02.2026, accordingly, the petitioner, who is a man of clean antecedent, is directed to be released on bail furnishing bail bond of Rs.10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Arah, in connection with Bhojpur Cyber P.S. Case No.11 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita (for short
