This application for anticipatory bail arises out

of Harsidhi P.S. Case No. 698 of 2025 for the offences punishable under Sections 85, 80(2), 351, 352 and 3(5) of the B.N.S. and Section 3,4 of the D.P. Act.

As per the allegation, informant’s daughter was

married to co-accused Nitish Kumar in the year 2021 and out of wedlock two children were born who are presently aged about

2.5 years and 1 year. It has further been alleged that the daughter of the informant was tortured for dowry and for non fulfillment of the same she was killed. It has further been alleged that police was informed to come to the place of occurrence and the dead body of the deceased daughter of the informant was brought down which was in hanging position.

Learned counsel for the petitioners has submitted that the petitioners are grand mother-in-law, mother-in-law, brother-in-law (Nandosi) and married sister-in-law (Nanad) and there happens to be general and omnibus allegation against the petitioners. It has further been submitted that when the police arrived at the place of occurrence, as per the allegation in the F.I.R., the deceased daughter of the informant was in hanging position and it was brought down by the police. It has further been submitted that the witnesses examined during the course of investigation have also testified this fact that the deceased was brought down by the police, who was in hanging position. It has further been submitted, referring to the postmortem report, that the cause of the death of the deceased was opined as asphyxia due to hanging. It has further been submitted that the petitioner no. 1 is quite old and infirm lady and she is aged about 85 years while petitioner no. 2, who happens to be the mother-in-law of

the deceased, and used to reside separately from the deceased and her husband, and had got no concern with their day to day affairs, while father-in-law of the deceased had been taken into judicial custody. It has further been submitted that petitioner no. 3 and 4 resides separately as petitioner no. 4 used to reside with petitioner no. 3 in her matrimonial house. It has lastly been submitted that the petitioners have got no criminal antecedent.

Learned counsel for the State opposed the prayer of anticipatory bail of the petitioners.

Heard the parties and perused the record. Considering the facts and circumstances, let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran, in connection with Harsidhi P.S. Case No. 698 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
