Heard the learned counsel for the petitioner and

learned APP for the State through Video Conferencing.

The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 30(a) of Bihar Excise and Prohibition Act and Sections 308(6), 140(3), 62, 318(1), 3(5) of the BNS.

The case of the prosecution in brief is that, four bottle of Corex cough syrup was recovered from the car.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner since petitioner is not concerned in anyway with the car. Petitioner has been framed in this case only with a view to malign. He is having a criminal antecedent of one case. He is in custody since 27.03.2026.

vehemently opposed the prayer of the regular bail.

Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above-named petitioner is directed to be released on bail in connection with Falka P.S. Case No. 180 of 2025 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Special Excise Court-II, Katihar.
