This application has been filed by the petitioner seeking the quashing of F.I.R. No. 244 of 2025, registered at Aurangabad Town Police Station for offences under Section 303(2) of the B.N.S.

As per allegation, the petitioner is accused of stealing two 11 metre rail poles, causing a loss of Rupees 1,06,109/- (One lakh Six thousand One hundred Nine).

Learned counsel for the petitioner has submitted that petitioner, by way of filing supplementary affidavit, has brought on record the deposit slip as regards the payment of Rupees 1,06,109/- to the South Bihar Power Distribution Co.

Ltd. On 20.05.2026. It has further been submitted that petitioner is a student preparing for competitive examinations. It has further been submitted that there is no eye witness to the alleged theft, and on mere basis of presumption, the present case has been lodged. It has further been submitted that the alleged poles were not in use, as they were actually the dead poles and the authorities of the South Bihar Power Distribution Co. Ltd. ought to have removed the poles from the plot of the petitioner.

Learned counsel for the Electricity Department submits that the offences are compoundable.

Be that as it may, since the alleged loss amount has been deposited and the Electricity Department has got no grievance against the petitioner, whatsoever, in the interest of Justice, Aurangabad Town P.S. Case No. 244 of 2025 as well as the order taking cognizance dated 24.09.2025 are hereby quashed.
