2. The petitioners have preferred this application for grant of regular bail in connection with Kalyanpur P.S. Case No. 374 of 2024, dated 10.11.2024, registered for the offences punishable under Sections 191 (2), 191 (3), 190, 126 (2), 127 (2), 115 (2), 118 (1), 105, 76, 303 (2), 351 (2), 352 of B.N.S.

3. As per the prosecution case, on 10.10.2024, at about 07:30pm, FIR named accused persons including petitioners came at the door steps of the informant, having armed with lathi and rod, and assaulted the son and the daughter-in-law of the informant and also took away ornaments

worth Rs. two lakhs. In the said occurrence, the informant’s son sustained grievous injuries and during the course of treatment at Motihari, Muzaffarpur and Patna succumbed to his injuries.

4. Learned counsel for the petitioners has submitted that there is general and omnibus allegations against the petitioners along with fourteen other named co-accused persons. It has further been submitted that the postmortem report goes to show that the autopsy surgeon has found three stitched wounds and one lacerated wound on the head and the same is not specifically attributed to the petitioners. It has further been submitted that the injuries were caused by sharp cutting weapon and it has not been alleged that petitioners were holding sharp cutting weapons. It has further been submitted that the coaccused person namely, Lakshman Shah, has been granted the privilege of anticipatory bail by a coordinate Bench of this court by order dated 15.12.2025, passed in Cr. Misc. No. 41345 of 2025 and another co-accused, Nilam Devi has also been granted the privilege of regular bail by a coordinate Bench of this Court by order dated 11.08.2025 passed in Cr. Misc. No. 48899 of 2025. It has further been submitted that, although the case was registered under Section 105 and other ancillary Sections of the Indian Penal Code, but charge sheet has been filed under

Section 103 (1) of the B.N.S. and other allied Sections. It has further been submitted that petitioner has got no criminal antecedent. It has lastly been submitted that the petitioner is in custody since 22.01.2026, charge sheet has been submitted and there is no allegation of tempering against the petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Heard the parties and perused the records.

7. Considering the facts and circumstances of the case as well as parity, the petitioners above-named are directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-12th, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No. 374 of 2024, dated 10.11.2024.
