The petitioner has prayed for bail in connection with Bangaon P.S. Case No. 106 of 2024 registered for the offence punishable under Sections 103(1), 61(2), 54, 351(3) of the B.N.S., 2023 and Section 27 of the Arms Act.

The case of the prosecution in short is that unknown miscreants killed the father of the informant when he was in a salon.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. The petitioner is not named in FIR rather his name has transpired in the confessional statement of co-

accused persons, namely, Ashish Anand and Balkishan Kumar and they told co-accused Brajesh to conceal the weapons of assault in the house of this petitioner. During investigation, the same was recovered from his house. Learned counsel has submitted that it is the statement of co-accused that weapons of assault was kept at the house of this petitioner and the same was recovered but it has not come during investigation that the petitioner was having knowledge or that in his knowledge, the weapons were kept in his house. He has no concern with the alleged recovery or with the alleged occurrence. Learned counsel has submitted that similarly situated other co-accused persons have already been granted bail by this Court vide Cr. Misc. Nos. 80384 of 2025 and 15604 of 2025. Moreover, the petitioner is languishing in judicial custody since 28.01.2026.

The application for bail is opposed by learned APP for the State.
