This is second attempt on behalf of the petitioner for grant of regular bail. Earlier his prayer was rejected by this Court vide order dated 11.02.2026 passed in Cr. Misc. No. 91962 of 2025.

Heard the learned counsel for the parties.

The petitioner, who is in custody, seeks bail in connection with Tarari P.S. Case No. 71 of 2022, dated 11.04.2022, registered for the offence(s) punishable under Section(s) 323, 341, 307, 504 and 506/34 of the Indian Penal

The allegation against the petitioner is that he along with two other named accused persons had assaulted the informant with lathi-danda and iron rods etc.

It has been submitted on behalf of the petitioner that his previous bail application, referred to above, was rejected with a liberty to him to move afresh after framing of the charge. It has further been submitted that apart from the fact that the allegations against the petitioner are general and omnibus in nature, there was a case and counter case between the parties for the same incident and the petitioner’s side had also received injuries. It has next been submitted that the petitioner carries one criminal case against his name, bearing Tarari P.S. Case No. 13 of 2015, wherein, he is on bail and he is in custody since 10.10.2025. It has lastly been submitted that vide order dated 26.03.2026, the charges have also been framed against the petitioner and the other accused persons.

The learned Addl. Public Prosecutor for the State, while vehemently opposing the prayer for grant of bail to the petitioner, has submitted that he had absconded after his anticipatory bail application was rejected in the year 2023 and, ultimately, he was taken into custody on 10.10.2025.

Regard being had to the facts and circumstances of

the case and taking into account the nature of allegations leveled against the petitioner as also the fact that he is in custody since 10.10.2025, let the petitioner, above-named, be released on bail on his/her furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Tarari P.S. Case No. 71 of 2022, subject to the following conditions:-

(i) One of the bailors of the petitioner shall be his/her close relative and the other shall be a local resident.

(ii) The petitioner shall remain physically present before the concerned Court on each and every date of the trial and shall cooperate in the investigation.

(iii) In case of absence for two consecutive occasions or in violation of the terms of the bail, the bail bonds of the petitioner will be liable to be cancelled by the concerned Court.

(iv) The concerned Court shall verify the criminal antecedents of the petitioner and in case, at any stage, it is found that he/she has concealed his/her criminal antecedents, the Court concerned shall take necessary steps for cancellation of his/her bail bond. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
