The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act.

The case of the prosecution is that from a bike, altogether 60.48 liters illicit foreign liquor was recovered.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Learned counsel for the petitioners has submitted that petitioner no. 1 is the driver and petitioner no. 2 is the pillion rider. Nothing has been recovered from the possession of the

petitioners. There is no independent witness of the seizure list rather they are police personnel and police has not complied Section 105 of BNSS while preparing the seizure list. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Learned counsel has further submitted that the said bike is registered in the name of the father of the petitioner no. 1. Moreover, they are languishing in judicial custody since 24.03.2026.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Brahmpur P.S. Case No. 87 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Special Court No. 2, Buxar.
