The petitioner apprehends his arrest in connection with Complaint Case No. (CA) 608/ 2024 in which cognizance has been taken for the offence(s) punishable under section(s) 498A of the IPC and under section(s) 3 and 4 of Dowry Prohibition Act.

Learned counsel for the petitioner submits that O.P. No.2 who was petitioner’s wife has not appeared despite service of notice upon her and the matrimonial relation between the petitioner and the O.P. No.2 has been dissolved and in this regard, the O.P. No.2 herself has sworn her affidavit, a copy of which has been filed with this petition as Annexure-2. It is

further submitted that after dissolution of the marriage, the O.P. No.2 has received permanent alimony from the petitioner and further, the allegations levelled by her against the petitioner are general and omnibus and there is no evidence with regard to the alleged physical torture and the O.P. No.2 was a married lady when she entered into matrimonial relation with the petitioner.

Learned APP appearing for the State opposes the prayer of the petitioner.

Considering the above submissions as well as facts and circumstances of this case, this court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Complaint Case No. (CA) 608/ 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
