The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

The allegation in the First Information Report is that 145 litres of country made liquor has been recovered from a Tampo.

Learned counsel for the petitioner submits that the petitioner is said to be the registered owner of the said Tempo, however, the Tempo was being used as a public carrier and the driver of the said Tempo managed to flee away. It is submitted that onne Vikram Kumar was apprehended and he has taken the name of the said driver and no person took the name of the

petitioner. There is no independent witness to the search and seizure. The petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail on the basis of allegations made in the First Information Report.

Taking into consideration the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Hisua P.S. Case No. 734 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
