Heard Mr. P.N. Shahi, learned senior counsel for the petitioner and learned A.P.P. for the State.

Mr. Jharkhandi Upadhyay, learned A.P.P. for the State has filed his counter-affidavit.

This is the 2^nd attempt of the petitioner seeking bail in connection with Shri Krishnapuri P.S. Case No. 149 of 2025 registered for the offence under Sections 103(1), 109, 115(2), 118(1), 117(2), 132, 324(4), 324(5) & 3(5) of the B.N.S.

Earlier, the bail application of the petitioner was rejected on 08.09.2025 in Cr. Misc. No. 60431 of 2025 which reads as follows:-

2. The petitioner seeks bail in connection

with S.K. Puri P.S. Case No. 149 of 2025 registered for the offence under Sections 103(1), 109, 115(2), 118(1), 117(2), 132, 324(4) and (5), 3(5) of the BNS.

3. As per the prosecution case, the petitioner is accused of killing a police official.

¶21

4. The petitioner is in custody since 12.06.2025.

¶22

5. Learned senior counsel for the petitioner submits that the petitioner is innocent and other similarly situated accused persons have already been granted bail.

6. Considering the gravity of the offence and the fact that the petitioners are involved in the killing of a police official, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed ”

As per the prosecution case, the petitioner is

accused of killing a police official.

¶27

Learned senior counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 12.06.2025. He further submits that though the charge-sheet was submitted under Section 103 and 109 of B.N.S. but the Court has taken cognizance under Sections 105 and 106 of B.N.S., and therefore, the offences of murder are not made out.

Learned A.P.P. for the State opposes the prayer for

bail.

Considering the allegation, the period of custody and the fact that no offence under Section 103 of B.N.S. has been found to be made out by the Court below, this application for regular bail is allowed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Shri Krishnapuri P.S. Case No. 149 of 2025.

It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
