The accused/petitioner seeks bail in connection with Siwan Town P.S. Case No.333 of 2024 registered for the offences punishable under Sections 147, 149, 341, 504, 506 307 and 120(B) of the Indian Penal Code (in short ‘IPC’) and 27 of the Arms Act.

The accused/petitioner is named in the FIR and is

in custody since 09.10.2025.

As per FIR, petitioner alleged to open firing on informant along with other named co-accused persons causing bullet injury to his knee.

It is submitted by learned counsel appearing for the petitioner that the allegation of firing is available against three named co-accused persons including petitioner from the short range, where only one bullet injury was noticed on the knee of the informant, which is non-vital part, negating prima facie intention to cause death and also the allegation doubtful. It is further submitted that with this much allegation, petitioner remains in custody since last ten months. While concluding argument, it is submitted that investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence and moreover, after framing of charge not even a single prosecution witness was examined in last ten months, till when the petitioner is in custody. Explaining criminal antecedent, it is submitted that the petitioner found involved in two more criminal cases, where he is on bail.

Learned APP opposed the prayer for grant of bail to the petitioner.

In view of aforesaid factual submissions and by taking note of fact, as investigation of this case is already concluded, coupled with the fact that petitioner remains in

custody since 09.10.2025, and as not a single prosecution witness examined till now as submitted, sufficiently suggesting that trial of this case is not likely to conclude in near future, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1^st Class, Siwan in connection with Siwan Town P.S. Case No.333 of 2024 subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short ‘CrPC’)/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short ‘BNSS’).
