Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in connection with Laxmipur P.S. Case No. 275 of 2025 dated 28.10.2025 registered for the offence punishable under Sections 74, 351(2), 191(2), 191(3), 127(2), 126(2), 117(2), 118(1)(2), 115(2), 109(1), 190 and 303(2) of the B.N.S., 2023.

As per prosecution case, the accused persons intercepted the informant's son, tied him to a pole, and assaulted him with a lathi. When the informant intervened, accused Indradeo Bind, along with Manish and Mrityunjay, allegedly assaulted her with an axe causing a head injury and snatched her

gold Mangalsutra. It is further alleged that the informant's daughter-in-law, who came to their rescue, was also assaulted with a lathi, resulting in a fracture of her right hand.

Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case. It is next submitted that there is a case and counter case between the parties and both sides have sustained injuries. It is further submitted that, although six persons have been named in the F.I.R., co-accused Indradeo Bind and Manish have already been granted anticipatory bail on the basis of the same and similar allegations. It is next submitted that while the specific allegation against Indradeo Bind, Manish and Mrityunjay is of assaulting the Informant, the injuries sustained by the informant have been found to be simple in nature. It is further submitted that as a matter of fact, the father of the petitioners’ namely Indradeo Bind had earlier lodged a case bearing Laxmipur P.S. Case No. 252 of 2025 against the Informant's son and others and the present case is the counterblast to the same. It is lastly submitted that the petitioner nos. 1 has two criminal antecedents whereas petitioner no.2 has no antecedent.

On the other hand, the learned APP for the State has

opposed the prayer for bail of the petitioners.

Having heard learned counsel for the parties and considering the fact that there is a case and counter case between the parties for the same and similar offence in which both sides have sustained injuries which have been found to be simple in nature, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Jamui in connection with Laxmipur P.S. Case No. 275 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. as well as the following conditions:

(i) One of the bailors should be the family member/relative/known of the petitioner(s) who shall provide official document / personal affidavit to show his/her bona fide;

(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;

(iii) the petitioner(s) shall in no way try to induce or

promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

¶25

(iv) the petitioner(s) shall desist from committing any criminal offence again in future, failing which the State shall be at liberty to take steps for cancellation of their bail bonds.
