2 . The petitioner has preferred this application for grant of regular bail in connection with Barun P.S. Case No. 79 of 2025 registered for the offences punishable under Sections 96 and 3(5) of the B.N.S.

3 . As per the prosecution case, the daughter of the informant aged about 17 years was kidnapped by petitioner and others for the purposes of marriage.

4 . Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that the allegation against the petitioner is false. It has been submitted that victim in her statement recorded under Section 183 BNSS has stated that she was in love with this petitioner and wanted to marry him. Thereafter, on 20.02.2025 the victim called this petitioner and she joined the company of the petitioner on her own sweet

will. It has further been submitted that there is no allegation of “enticing away” and “taking away” against the petitioner. It has further been submitted that the victim was of not of such a tender age so as not to understand the consequences. It has further been submitted that although petitioner is accused in four other cases but he is in bail on those cases. It has further been submitted that the petitioner is in custody since 27.02.2025.

5 . Learned APP for the State has vehemently opposed the prayer for bail of the petitioner and submitted that the victim was minor at the time of occurrence.

Considering the aforesaid submissions of the parties and taking into account the facts and circumstance of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, in connection with Barun P.S. Case No. 79 of 2025.
