The petitioner has preferred this application for grant of regular bail in connection with Gopalganj Excise P.S. Case no. 65 of 2026 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 293.76 liters of IMFL was recovered from the karkat house of the petitioner in the village thus making total recovery of 301.32 liters of IMFL from the petitioner.

Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner’s

possession who has been falsely implicated in the case. He has no concern with the seized liquor. No independent witness has supported the prosecution case and the petitioner is in custody since 29.01.2026.

The application for bail is opposed by learned APP for the State.

¶19

Having heard learned counsel for the parties and taking into consideration the total recovery of 301.32 liters of which 293.76 litres of IMFL was recovered from the karkat house of the petitioner together with the petitioner having an antecedent under the Bihar Prohibition and Excise Act, 2016, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

Liberty is granted to the petitioner to renew his prayer for bail after six months.
