Case No. 123 of 2021, registered for offences punishable under Sections 363, 365, 366(A) read with Section 34 of the Indian Penal Code. The petitioner's earlier bail prayer had been rejected by the same Bench on 24.04.2023 in Cr. Misc. No. 64816 of 2022, with liberty to renew after examination of the victim or after expiry of one year. Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Special POCSO Case No. 51 of 2026, arising out of Rajivnagar P.S. Case No. 123 of 2021, registered for the offences punishable under Sections 363, 365, 366(A) read with Section 34 of the Indian Penal Code.

The main submissions advanced by the petitioner's counsel are that this is the second attempt of the petitioner to get the relief of regular bail, though his earlier prayer has already been rejected by this Bench vide order dated 24.04.2023 passed in Cr. Misc. No. 64816 of 2022 in which the petitioner was

given a liberty to renew his bail prayer either after the examination of the so-called victim or after expiry of one year period from the earlier rejection order on this condition, if in the said one year period, the victim is not produced and examined as a witness in the petitioner's trial and in the light of this given liberty, the petitioner has renewed his prayer. Learned counsel further submits that despite the lapse of more than three years period after the rejection of petitioner's first prayer, the victim has not appeared before the trial court for recording her evidence without any reason and in this regard, a specific statement has been made in the paragraph no.17 of this petition and the petitioner has suffered a lot as he has been languishing in jail since 19.05.2022 and further, the parties have entered into compromise and in this regard, copy of the compromise petition has also been filed as Annexure- P/3.

Learned APP appearing for the State has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions and mainly taking into account the prosecution's lingering attitude in producing and examining the victim despite the lapse of more than three years coupled with the petitioner's custody period and his fair and clean antecedent, this court is now inclined to

release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned court in connection with Special POCSO Case No. 51 of 2026, arising out of Rajivnagar P.S. Case No. 123 of 2021.
