Learned APP for the State.

The petitioners are apprehending arrest in connection with Barachatti (Mohanpur) P.S. Case No.21 of 2024 lodged on 10.01.2024, for the offences punishable under Sections 341, 323, 504, 506, 308, 379 and 34 of the IPC.

As per the prosecution, FIR has been lodged against 6 named accused persons (the present petitioners) against whom

there is allegation that they have assaulted the informant by lathi due to which head injury sustained. They have also assaulted the informant’s wife by lathi blow on waist and whole body.

Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that petitioner No.6 and informant are full brothers (agnates) and dispute has taken place in the family on petty issue. He further submits that scuffling took place from both sides and injury has also caused to both sides. He further submits that for the same date and place of occurrence, there are case and counter-case from both sides.

Counsel submits that the criminal antecedent of the petitioners is clean and ready to fulfill all the conditions whatsoever shall be imposed upon them.

Learned APP for the State opposes the prayer for bail of the petitioners and submits that scuffling took place between the agnates.

As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand)

each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of ACJM-2nd, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S. Case No.21 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS , 2023.
