Heard learned counsel for the parties.

The petitioner has renewed her prayer for grant of

regular bail in connection with Darauli P.S. Case no.364 of 2022 registered under sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, the informant states that as a result of altercation between the petitioner and his wife, both of whom happen to be gotni (sister-in-law), as narrated by his wife, the petitioner strangulated their 10 year old son and then threw him from the terrace as a result of which he fell down and died. The informant further states that the occurrence was seen by his parents.

Learned counsel for the petitioner submits that the earlier application for bail of the petitioner was rejected vide order dated 17.2.2024 passed in Cr. Misc. no.6747 of 2024. Inspite of

the petitioner having remained in custody since 24.12.2022 for more than 3 years 3 months, the trial has still not concluded and as such the petitioner be enlarged on bail. The petitioner undertakes to cooperate in the trial and to abide by any conditions which may be laid by this Court for her release on bail.

The prayer for bail is opposed by learned A.P.P for

A report was called for from the learned trial Court. As per the report received contained in letter dated 8.4.2026, the examination of six prosecution witnesses has taken place. The prosecution has further prayed for time for examining two medical doctors namely Shri. Prashant Mishra and Shri. Mukesh Kumar Ranjan and the next date is 21.4.2026.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R and the trial having proceeded, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

Taking into consideration the period in custody, the learned trial Court is directed to concluded the trial within six months.
