Heard learned counsel for the petitioner and

learned A.P.P. for the State.

The petitioner apprehends her arrest in a case

registered under Sections 103(2), 3(5), 61(2) of the B.N.S.

As per prosecution case, the marriage of informant’s

¶16

sister was solemnized with Vimlesh Kumar in the year 2003. After sometime of marriage, it was came to the knowledge of the informant’s sister that Vimlesh Kumar was having an extra marital relationship with the petitioner. When informant’s sister objected, she was subjected to physical abuse and threatened with dire consequences. It is alleged that on 01.12.2024, the informant received the news of death of her sister. Informant raised suspicion that the husband of the informant’s sister and

this petitioner killed her sister.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. The petitioner has no concern with the deceased or her husband. Except being the co-villager, petitioner has no relation with the co-accused. There is no external injury in the postmortem report of the deceased and Viscera has been sent to the Forensic Lab. Learned counsel for the petitioner further submits that petitioner is a lady having a child of 18 months and she has no criminal antecedent. There is no chance of absconding or tampering with the evidence. She undertakes to cooperate in the investigation and trial.

Learned A.P.P. appearing on behalf of the State opposed the bail application.

Having considered the facts and circumstances of the case, submissions of learned counsel for the parties, nature of allegation and clean antecedent of the petitioner, who is a lady, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of learned concerned
