The petitioner apprehends his arrest in a case registered for the offences punishable under Section 132, 109(1) and 3(5) of the B.N.S., Section 30 (a) of the Bihar Prohibition and Excise Act and Section 25 (1-b)a, 26 and 27 of the Arms Act.

A bare perusal of the first information report and the seizure list would go to show that 752.600 liters of foreign liquor has been recovered from a boat.

It is submitted by learned counsel for the petitioner that no recovery has been made from the conscious physical possession of the petitioner rather the same has been recovered from a boat, which does not belong to the petitioner, hence the liability cannot be fastened on the petitioner. The name of the petitioner has transpired in this case on the basis of disclosure
