Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Siwan Town P.S. Case No. 810 of 2024 corresponding to Sessions Trial No. 194 of 2025 instituted for the offences punishable under Sections 80(2), 61(2) and 3(5) of the BNS, 2023.

As per allegation in the FIR, it is case of dowry death due to non-fulfillment of dowry demand of Rs. 5,00000/by the petitioner and his family members and the petitioner is husband of the deceased.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submit that the marriage of informant’s daughter was solemnized with Amit Kumar @

Sonu on 07.12.2023 and after marriage his daughter went to the matrimonial home. He further submits that the entire allegation against the petitioner is baseless, concocted and unbelievable. He next submits that all the witnesses have been examined in this case except the official witnesses. He lastly submits that the allegation regarding demand of dowry is totally unbelievable. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 31.12.2024.

Learned APP for the State opposes the prayer for regular bail of the petitioner.

From perusal of the FIR, case diary, postmortem report, status report and also perused the impugned order dated 21.01.2026 passed by the learned Additional Sessions Judge-III, Siwan, it appears that petitioner is named in the FIR. From perusal of the records, it also appears that the witnesses in the case diary has supported the case of the prosecution. The specific allegation against the petitioner is that he along with other co-accused persons murdered the daughter of the informant by strangulation for non-fulfillment of demand of dowry and the postmortem report also shows that the cause of death was asphyxia due to antemortem injury cause by throttling. 2026 dated 19.05.2026 sent by the learned District and Additional Sessions Judge-III-cum Special Judge of MPs /MLAs/MLCs Court, Siwan, it appears that the charge has been framed on 28.05.2025, out of eleven prosecution witnesses five have already been examined and the case is pending for evidence of Doctor and Investigating Officer and bailable warrant upon the remaining witnesses have also been issued against them and the trial is under progress, so considering the facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to grant regular bail to the petitioner.
