The petitioner has prayed for bail in connection with Charpokhari P.S. Case No.257 of 2015 registered for the offence punishable under Sections 364, 302, 120(B) and 201 read with Section 34 of the IPC.

The case of the prosecution, in short, is that one Sanjay Yadav was taken away by Dasrath Paswan, Kariya Sah and 4-5 other persons at the point of gun. During course of investigation, one Deepak Paswan was apprehended and he has given his confessional statement.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

case. The name of this petitioner is not there in the F.I.R. but his name has surfaced in the confessional statement of co-accused Deepak Paswan. It has further been submitted that later on the dead body of Sanjay Yadav was recovered. Learned counsel for the petitioner has submitted that save and except the confessional statement, there is nothing against the petitioner. He was not knowing about his involvement in this case. The police has apprehended him in year 2025. It has also been submitted that other co-accused persons Deepak Paswan, Pappu Paswan and Raghu Nath Ram, Bihari Ram and Raj Kumar Ram have been granted bail by learned Co-ordinate Benches of this Court vide Cr. Misc. No. 2641 of 2016, 19274 of 2016 and 15948 of 2018. The case of this petitioner stands on similar footing. Moreover, he is in judicial custody since 22.03.2025.

Learned APP appearing for the State has vehemently opposed the application for bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
