The petitioner apprehends his arrest in

connection with Patkhouli P.S. Case No. 281 of 2025 for the offence punishable under Sections 126(2), 331(4), 115(2), 109(1), 74, 303(2), 3(5) of the BNS, 2023.

As per the prosecution case, on 19.11.2025 at about 09:00 P.M., all the accused persons, armed with lathi, danda and farsa, forcibly entered the informant’s house after breaking the door and assaulted the informant and his family members. The petitioner allegedly assaulted the informant on his head and a farsa with intention to kill him. It is further alleged that the accused persons also assaulted other family members and snatched Rs. 50,000/- kept for marriage purpose and created obstruction in the marriage ceremony fixed on

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that after withdrawal of case bearing complaint case No. 688 of 2025 lodged by one of the coaccused against the informant, the instant case is said to have been lodged against the petitioner and others. It is further submitted that there is no motive imputed against this petitioner for having caused injuries to the informant’s side. Learned counsel for the petitioner submits that the allegations levelled against this petitioner, who is said to have caused injuries to the informant with farsa is not corroborated with the nature of injuries sustained by the informant while the same has been found to be simple in nature caused by hard substance. Lastly, it is submitted that the petitioner has clean antecedent and both the sides are co-villagers also undertake to maintain peace.

On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioner.

Taking into account that the petitioner’s side initially attempted to resolve the issues by withdrawing the cases filed by one of the co-accused against the informant and his family members and that further the injuries sustained is not

corroborating the allegations made by the informant, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1^st , Bagaha, West Champaran, in connection with Patkhouli P.S. Case No.281 of 2025 subject to the conditions as laid down under Section 482(2) of the BNSS as well as the following conditions:

(i) One of the bailors should be the family member/relative/known of the petitioner(s) who shall provide official document/ personal affidavit to show his/her bona fide;

(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her/their bail bond by the Trial Court itself;

¶25

(iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner(s) shall desist from committing any

criminal offence again, failing which the State shall be at liberty
