Heard Mr. Dwij Raj, learned counsel appearing on

behalf of the petitioners and Mr. Ganesh Prasad Singh, learned APP for the State.

The petitioners seek pre-arrest bail in connection with Nanpur P.S. Case No. 282 / 2025 registered for the offence(s) punishable under Sections 126(2), 127(2), 115(2), 118(1), 303(2), 352, 351(2), 109 and 3(5) of the BNS.

As per the allegation made in the FIR, the petitioners along with other co-accused had snatched Rs.25,000/- from the informant and they also assaulted, in which, three persons including the informant were injured.

Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and known to the informant and due to past enmity, the petitioners no.1 and his two sons, petitioners no.2 and 3 have been roped in the present case. General and omnibus allegation has been levelled against petitioners no.1 and 3. Allegation against petitioner no.2 is that he had snatched a sum of Rs.25,000/- from the informant. Petitioners have clean antecedents. On these grounds, petitioners seek to be released on pre-arrest bail.

Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Having heard the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the FIR, from which, it appears that the informant has alleged that the petitioner no.2 had snatched a sum of Rs.25,000/- from the informant and also assaulted the informant and other persons, however, the informant had overpowered the petitioners and grabbed the motorcycle, which was admittedly handed over to the police. General and omnibus allegation has been levelled against the petitioners no.1 and 3. Petitioners are own family members and allegation as alleged in the FIR is being not convincing, I am of the opinion that petitioners have,

prima facie, made out a case to be released on pre-arrest bail.

The petitioners, above named, are directed to be

released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi / Concerned Court in connection with Nanpur P.S. Case No. 282 / 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.

The learned District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases, as what has been stated in paragraph no.3 of the bail application, this order will automatically lose its force.
