Patna High Court, Criminal Miscellaneous No.14287 of 2016, decided 16-02-2026 (Shailendra Singh, J): Petition under section 482 of the Code of Criminal Procedure by four brothers (Ugan Paswan, Rajesh Paswan, Rakesh Kumar Paswan and Amaresh Paswan) seeking quashing of the order dated 22.11.2014 of the Judicial Magistrate 1st class, Begusarai, taking cognizance of offences punishable under sections 147, 323, 504 and 379 IPC in Complaint Case No. 13994(C) of 2014, filed by Ram Sumaran Paswan (O.P. No. 2), whereby the petitioners were summoned. Background: the petitioners' sister Vina Kumari married Sujeet Kumar (son of O.P. No. 2) on 27.01.2012; after disputes she lodged Dalsingsarai P.S. Case No. 225 of 2014 against her father-in-law and others; the complaint case followed, and the husband filed Matrimonial Suit No. 31/2014. The parties subsequently entered into a compromise pursuant to which the matrimonial suit stood decreed and Vina Kumari's case was compromised; counsel for O.P. No. 2 accepted the compromise petition and affidavit. Holding: continued trial would be complete harassment to the petitioners and the criminal proceedings appeared initiated with malicious intention; accordingly the cognizance order was set aside and the subsequent criminal proceedings quashed. The criminal miscellaneous petition stands allowed.
