Heard learned counsel for the petitioners and learned

APP for the State.

The petitioners seek bail in connection with Barauli P.S. Case No. 368 of 2025 registered for the offence punishable under Sections-70(1), 3(5) of B.N.S. and 4 & 6 of POCSO Act as also under Section-67 of I.T. Act.

As per allegation, while the minor daughter of the informant went towards canal to defecate, the petitioners alongwith others committed rape upon her and video clip was made.

Learned counsel for the petitioners has submitted

that the petitioners are innocent and they have committed no offence whatsoever. They have falsely been implicated in this case due to dirty village politics. There is a delay of six days in lodging of the FIR and no explanation has been offered for the said delay. It has next been submitted that the petitioners are in custody since 04-11-2025.

Learned APP has opposed the prayer for bail.

There is allegation of rape against the petitioners upon a minor girl and it is also alleged that video clip was made. The victim in her statement recorded under Sections 180 & 183 of the BNSS has supported the prosecution case.

Considering the aforesaid facts and circumstances,

I am not inclined to grant bail to the petitioner and accordingly, the same is rejected .
