Heard the learned counsel for the petitioner and

learned APP for the State.

The petitioner apprehend his arrest in connection with Tetarhat P.S. Case No. 149 of 2025, for offences under Sections 30(a), 34 of the Bihar Prohibition and Excise Act.

The prosecution case, 40 litres of illicit country made liquor have been recovered from a Toto vehicle.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The son of the petitioner was arrested on the spot and he has been granted regular bail by this Court vide order dated 23.09.2025 passed in Cr. Misc. No. 63615 of 2025. Petitioner claims clean antecedent. Petitioner has no concern

with the alleged recovery.

Learned APP for the State has vehemently opposed the prayer for bail.

Considering the above facts and circumstances of the case and the fact that similarly situated co-accused person has been granted regular bail by this Court and petitioner claims clean antecedent, the application for anticipatory bail stands allowed.

Accordingly, let the petitioner, above-named, in the event of arrest or surrender within four weeks from today in the Court below, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-VII-cum-Exclusive Special Excise Court II, Lakhisarai/concerned Court below, in connection with Tetarhat P.S. Case No. 149 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ Section 482(2) of the BNSS.
