Heard Learned Counsel for the petitioner and Learned APP for the State.

The petitioner is apprehending arrest in connection with Kochadhaman P.S. Case No.145 of 2025 lodged on 03.04.2025, for the offences punishable under Section 108/3(5) of the BNS.

As per the prosecution, FIR has been lodged against four named accused persons including the present petitioner with allegation that the abetment has been made by the accused persons which resulted into suicide of husband of the informant.

Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that from the contents of FIR, it becomes crystal clear that the allegation has been made against four accused persons, there is general and omnibus allegation against the petitioner. There is nothing specific against the petitioner. He specifically pleaded that in the family of the husband of the

informant, there is tendency of committing suicide as one of the brother and sister had also committed suicide earlier.

Counsel submits that the criminal antecedent of the petitioner is clean and ready to fulfill all the conditions whatsoever shall be imposed upon him.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that from the inquest report, death has been caused by consuming poison.

As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of J.M.F.C., Kishanganj in connection with Kochadhaman P.S. Case No.145 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS , 2023.
