The petitioner has prayed for bail in connection with Sheosagar P.S. Case No. 316 of 2025 registered for the offence punishable under Sections 109, 103, 352, 351(2) and 3(5) of B.N.S. and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

The case of the prosecution, in short, is that the petitioner has brought a gun from his house and handed it over to one Sunil Singh who has fired at Shivani Kumari who succumbed to the injuries during treatment.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R., it is clear that it is Sunil Singh who has fired at Shivani Kumari. Only role attributed to the petitioner is that he has given the gun to Sunil Singh. It has further been submitted that during course of investigation, Sunil Singh has given his confessional statement and in his confessional statement, he has stated that he has concealed the gun in his house and he himself has brought the gun and has fired. It has further been submitted that in any view of the matter, the main assailant is Sunil Singh. The petitioner has not fired at any one. Petitioner is languishing in judicial custody since 12.10.2025.

Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the application for bail and have submitted that petitioner is having criminal antecedent of three cases. Learned counsel for the informant has submitted that the petitioner is the main culprit. He has handed over the gun from which fire was made. The confessional statement made by Sunil Singh only to save this petitioner. The witnesses examined during investigation have categorically stated that the gun was handed over by this petitioner.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Rohtas, Sasaram in connection with Sheosagar P.S. Case No. 316 of 2025.
