The petitioner seeks bail, who is in custody since 18.10.2022 in connection with Pasraha P.S. Case No. 72 of 2020, FIR dated 02.08.2020 registered for the offence under Section 302 and 34 of Indian Penal Code.

Earlier the bail application of the petitioner was rejected thrice vide order dated 08.12.2021, 19.07.2023 and 10.05.2024 in Cr. Misc. No. 39395 of 2020, Cr. Misc. No. 26029 of 2023 and Cr. Misc. No. 18367 of 2024.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case trial is not in progress and the petitioner

is rotting in judicial custody since 18.10.2022.

Vide order dated 18.03.2026 a report was called

with regard to stage of the trial. Report of the learned Trial Court dated 25.03.2026 reveals that out of fourteen charge-sheet witnesses, eleven witnesses have been examined and case is pending for examination of rest three witnesses.

Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that there is direct and specific allegation of firing against the petitioner which is supported by medical evidence.

Considering the facts and circumstances of the case as well as nature of allegation and report of learned trial court, I am not inclined to enlarge the petitioner on bail in connection with Pasraha P.S. Case No. 72 of 2020 pending in the Court of District & Additional Sessions Judge-I, Khagaria.

Prayer is refused.

However the learned Trial Court is directed to expedite the trial and conclude the same at the earliest.
