Prosecution case: three armed miscreants told a Poclain Operator to stop work and demanded levy from the contractor, and a call was thereafter received alleging that 'Naxali Mukesh' was demanding levy of 5%. Counsel submitted that the F.I.R. named unknown miscreants and the petitioner's name surfaced only through the confessional statement of co-accused Rahul Kumar during investigation; the co-accused had already been granted bail by a Coordinate Bench (Cr. Misc. No. 89164 of 2025), and the petitioner was in judicial custody since 16.09.2025. Learned APP opposed, citing the petitioner's criminal antecedent in three cases. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for bail in connection with Gurua P.S. Case No. 192 of 2025 registered for the offence punishable under Sections 308(5) and 3(5) of B.N.S.

The case of the prosecution, in short, is that three armed miscreants told the Poclain Operator to stop the work and directed him to ask the contractor to pay levy after that they will be able to start the work. It is further alleged that on the next day also a call was received on the mobile of the informant to the effect that Naxali Mukesh was calling from other side and was demanding levy of 5%.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

offence. He has been falsely implicated in this case. The F.I.R. was lodged against unknown miscreants. During course of investigation, co-accused Rahul Kumar has given his confessional statement and the name of this petitioner has surfaced in the confessional statement of Rahul Kumar. It has also been submitted that co-accused Rahul Kumar has been granted bail by learned Coordinate Bench vide Cr. Misc. No. 89164 of 2025. The case of this petitioner stands on better footing. Petitioner is languishing in judicial custody since 16.09.2025.

Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of three cases.
