Petitioner seeks bail who is in custody since 04.11.2022 in connection with Lakhisarai (Kabaiya) P.S. Case No. 685 of 2021 for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354(B), 379, 504 of I.P.C.

The case of the prosecution in brief is that on 09.10.21 at about 04: 00 o'clock in the evening she was sitting at her house, meanwhile all named accused persons came there with deadly weapon and started abusing her, then all are assaulting to her daughter in law and Naresh Mahto tried to molest her. Thereafter her son Sikandar Mahto and Yogendra Mahto tried escape him, meanwhile Petitioner assaulted with axe on the head of informant, upon which her head was broken

and blood was oozing. Niraj Mahto assaulted with iron rod on the head of Yogendra Mahto due to which his head was broken and blood was oozing. Naresh Mahto assaulted with khanti on the leg of Sikandar Mahto due to which he sustained leg injury and others have also assaulted with bamboo stick. Further alleged that during that period Rabita Kumari snatched ear ring of informant and Kavita Devi @ Mina Devi has also snatched golden chain from the neck of informant, For which Lakhisarai (Kabaiya) P.S. Case No. 685 of 2021 u/s 147,148,149,341,323,324,307,354(B), 379,504, later on u/s 302 of I. P. C has been added by order dated 17.11.2021.

Learned counsel for the petitioner submits that earlier the bail petition was rejected vide order dated 27.04.2023 and 10.09.2025 passed in Cr. Misc. No. 5421 of 2023 and Cr. Misc. No. 46321 of 2025 and petitioner is in custody since 04.11.2022. Vide order dated 22.04.2026 report was called for with regard to the stage of the trial. Report dated 05.05.2026 reveals that out of eight charge-sheet witnesses, seven witnesses have been examined.

The learned Additional Public Prosecutor for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner.

Considering the nature of allegation as alleged in the FIR as well as report of the trial court, I am not inclined to enlarge the petitioner on bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 685 of 2021 pending in the court of learned Additional Sessions Judge-III, Lakhisarai.
