The petitioner is in custody in a case registered for the offence punishable under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per allegation in the FIR, while the informant about the death of her son, namely, Vikku Kumar @ Mukesh, who is aged about 32 years and she had gone to Gaya hospital for his wife’s treatment and daughter-in-law came home after treatment at around 6.30 P.M and asked where was Vikku Kumar @ Mukesh, then she told that he had gone to his aunt’s place in village-Pota to bring his cousin, namely, Rani and the informant called his son Vikku but there was no response and

even after several attempts, he did not pick up the phone, then the informant inquired about Vikku, she found that her son was dead near canal.

Learned counsel for the petitioner submits that he has falsely been implicated in this case due to village politics. He next submits that petitioner is not named in the FIR and petitioner is a lady and she has got clean antecedent as stated in para-3 of the petition and she is in custody since 24.06.2025. He next submits that similarly situated co-accused, namely, Kamlesh Yadav @ Kamlesh Kumar has already been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No.75159 of 2025.

Learned APP for the State opposes the prayer for bail of the petitioner.

On perusal of the first information report, case diary, postmortem report of the deceased, namely, Vikku @ Mukesh Kumar and impugned order dated 18.02.2026, it appears that on 20.06.2025 petitioner has been seen together with the deceased, were found almost at similar places on the alleged date of occurrence and further the confessional statement of the petitioner regarding manner of committing murder by assaulting Mukesh Kumar and then by running over

Scorpio over him, finds corroboration from the postmortem report of the deceased, in which doctor has found tyre mark in right shoulder and abdominal area along with fracture of right ribs and thereafter Scorpio has also been seized by the police which is mentioned in para no.78 of the case and the confessional statement of the petitioner as well as co-accused Kamlesh Yadav regarding illicit relationship between them is also corroborated by the statement of the son of the deceased as also appears in para 101 of the case diary and the trial is also pending and several witnesses have supported the case of the prosecution, considering which, I am not inclined to grant regular bail to the petitioner.

Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

The trial Court is directed to expedite the trial.
