This contempt application has been filed alleging

violation of order dated 14.11.2017 passed in C.W.J.C. No. 3947 of 2014 in which the respondents were directed to regularize the service of the petitioner within four months from the date of

receipt of a copy of the order.

This Court, while setting aside and quashing the impugned order by which the petitioner’s services as work charge employee was terminated, further directed to the respondents to regularize the service of the petitioner.

The respondents have filed their show cause and supplementary show cause. In paragraph 5 of the supplementary show cause filed by the respondent nos. 1 to 3 and 8, it has been stated that the petitioner’s service has already been regularized in the light of the Resolution No. 10710 dated 17.10.2023 vide office order contained in Memo No. 518 dated 01.02.2024 passed by the Engineer-in-Chief-cum-Additional Commissioner-cum-Special Secretary, Rural Works Department, Government of Bihar, Patna. A copy of the aforesaid order also been annexed as Annexure – R/3 in the supplementary show cause filed.

From perusal of the Annexure-R/3, it appears that vide order dated 01.02.2024, passed by Engineer-in-Chief-cumAdditional Commissioner-cum-Special Secretary, Rural Works Department, Government of Bihar, Patna, the petitioner’s service has been regularized in the post of Chawkidar in the department by the resolution and memorandum referred
