The instant application has been filed in initiating a

contempt proceeding against the opposite parties for their willful disobedience of the order of this Court dated 05.10.2018, passed in C.W.J.C. No. 19403 of 2018, whereby the Court had directed the respondents to take appropriate decision with regard to the post-retiral dues, which is not otherwise subject to attachment on account of pendency of the departmental proceeding.

Show-cause as well as supplementary show-cause affidavits have been filed on behalf of the opposite parties. A categorical averment has been made in the supplementary showcause affidavit that vide PPO dated 21.05.2019, the office of the Accountant General (A & E), Bihar, Patna has sanctioned the pension payment order and gratuity payment order in favour of the petitioner and the pension is being regularly paid to the petitioner.

So far the arrears of salary for the period, in question, is concerned, the same has also been paid to the petitioner.

It is the contention of the learned Advocate for the opposite parties that admissible amount under the Group Insurance has also been paid. So far the GPF amount is concerned, the same shall be paid to the petitioner within a week

after following other process, as required thereto.

Learned Advocate for the petitioner contended that supplementary show-cause affidavit was filed on 06.02.2025, but till date the GPF amount has not been credited in the account of the petitioner.

Considering the supplementary show-cause affidavit reflecting the payment of all the admissible retiral benefits, the contempt petition stands disposed of with the hope and expectation that remaining admissible dues with regard to GPF amount shall be credited in the account of the petitioner preferably within a period of two weeks from today.

The contempt petition stands disposed of.
