The instant application is filed for initiation of a

contempt proceeding against the concerned opposite parties for their willful disobedience of the non-compliance of the order

dated 27.08.2019 passed in C.W.J.C. No. 9526 of 2019.

A show-cause affidavit is filed on behalf of the O.P. No.6 with a categorical averment that in compliance with the order of this Court, the claim of the petitioner was duly examined and on being found her claim identical to said Anita Kumari, the answering deponent has sanctioned the trained scale benefit to the petitioner vide fixation dated 11.09.2020. The show-cause affidavit also suggests that the arrears of payment accrued due to the new fixation in trained scale shall be paid to the petitioner very shortly.

Learned counsel for the petitioner, at this juncture, submitted that the petitioner has not been apprised as to whether the actual monetary benefit paid to him.

Be that as it may, considering the averments made in the show-cause affidavit, the present contempt petition stands closed.

¶31

However, the petitioner shall always be at liberty to approach before the concerned authority, in case, he has not been paid the actual monetary benefit.
