Heard Mr. Rama Kant Singh, learned counsel appearing on behalf of the petitioner and Ms. Binita Singh, learned SC 28 for the State.

The petitioner in paragraph no. 1 of the present writ petition has sought, inter alia , the following relief(s), which is reproduced hereinafter:-

“That this an application for issuance of appropriate writ (s)/direction(s) for directing to the respondent authorities to pay the dues arrear of salary to the petitioner from his appointment date i.e. on 26.06.2014 to till date as a post of Tola Sevak in Primary School, Posanda, Hilsa, Nalanda.”

There is no merit in the present writ petition and no writ can be issued in view of the fact that the petitioner has voluntarily performed the duty of Tola Sevak for the upliftment of the Economically Backward Class in his society. The law is well settled in this regard by a Co-ordinate Bench of this Court in CWJC No.11447 of 2018 (Md. Ejaaz Kauser Khan and Ors. Vs. The State of Bihar and Ors.) alongwith analogous cases and by the Division Bench of this Court in LPA No.2185 of 2015 (Ram Lakhan Ram Vs. State of Bihar and Ors.) .

Accordingly, the present writ petition stands disposed with a liberty to the petitioner to avail appropriate remedy, as and when, occasion so arises.
