1. The Writ petition is filed for the following

reliefs:-

“A) Issuance of an appropriate order, direction or writ in the nature of mandamus commanding respondents 1^st set to make payment of price of 270 quintals Customed Milled Rice (CMR) amounting Rs. 6,74,635.00 (Rs. Six Lac Seventy Four Thousand Six hundred Thirty Five and Fifty Paisa) to the petitioners;

B) Issuance of the writ in the nature of mandamus or any other appropriate order or direction commanding respondents 1^st set specially respondents no. 3 to 6 to pay the petitioner Rs. 6,74,635.50 with an appropriate interest thereupon calculated from 28.06.2018 till actual payment;

C) Issuance of an appropriate writ/order/ direction commanding respondent 2^nd set for not taking any coercive step against the petitioners towards recovery of the outstanding loan and for waiving interest on the principal for the period 28.06.2018 to the date when aforesaid mentioned payment of price of the CMR is made by the Bihar State Food & Civil Supplies Corporation to the petitioners.

D) Any other relief/reliefs for which, the petitioners are entitled to in the facts and circumstances of the case.”

2. During the course of arguments, it is

submitted by the Learned counsel for the petitioner that he is not pressing the relief as prayed for under

¶32

“prayer (C)” of the relief portion.

¶33

3. It is specific contention of the Learned counsel for the petitioner that the amount in question are the admitted dues which are to be paid by the respondents and as they were not paid to the petitioner, he was constrained to file the Writ petition.

4. On the other hand, the Learned counsel for the BSFC contended that no representation has been made before the Managing Director, who is the head of the Bihar State Food and Civil Supplies

Corporation which is the competent authority to deal with the matter. It is contented submitted that the petitioner should first approach the Managing Director, Bihar State Food and Civil Supplies Corporation for redressal of his grievance.

Without going into the merits of the case, this Court directs the petitioner to make a representation before the 4^th respondent i.e. the Managing Director, Bihar State Food and Civil Supplies Corporation, Patna, within four weeks from the date of receipt of this order along with all relevant and supporting documents. The Managing Director would consider the same and shall pass an appropriate order for resolving the dispute between the parties.

6. It is needless to mention that before passing any order, the Managing Director, Bihar State Food and Civil Supplies Corporation, Patna shall give an opportunity of hearing to the petitioner. Any order passed shall be communicated to the petitioner. The entire exercise shall be completed as

expeditiously as possible, preferably within a period of three months from the date of filing of the representation considering all the materials available before him.

7. With the aforesaid observation, the Writ petition is disposed of.
