action against the Circle Officer, Teghra and Anchal Amin, Teghra for not taking appropriate measures for measurement of the subjected land and for sitting tight, over the application for almost three years, of the petitioner for measurement of the subjected land.

(iii) For further directing the concern authorities to take appropriate action on the representation of the petitioner so that he may be able to enjoy the benefit of the land in question. (iv) For any other relief and reliefs for which the petitioner may be found entitled in the fact of the circumstance of the present case.

Mr. Anupam Bahadur, learned counsel for the petitioner and Mr. A.B. Sinha, learned G.A.-8 are present and they are heard.

The main grievance raised by the petitioner in this writ petition is that his land is not being measured by the revenue authorities despite an application with required fee having been filed by him in the prescribed format. It is submitted by the petitioner’s counsel that the Circle Officer, Teghra rejected the petitioner’s application for measurement of his land mainly on the basis of not matching boundaries of his land with the purchasers of the concerned sale deeds which is not sufficient to reject the petitioner’s application. It is further submitted that petitioner had again filed an application dated 14.06.2024 (Annexure- P/5) for the same relief but the same was also not decided.

118(3) of the Bihar Tenancy (Amendment) Act, 2017 to challenge the order of the Circle Officer before the Deputy Collector, Land Reforms and the said efficacious remedy has not been availed by the petitioner, so, at this stage, this court finds that the issue raised by the petitioner in this writ petition is premature for consideration by this court under Article 226 of the Constitution of India.

Accordingly, this writ petition stands disposed of with giving liberty to the petitioner to challenge the order of the Circle Officer by way of appeal under section 118(3) of the Bihar Tenancy (Amendment) Act, 2017 and if he avails this liberty in the next four weeks from today then the DCLR shall decide his appeal according to merit and the time spent by him in this writ petition shall not be taken into consideration while computing the necessary period of limitation.

With the aforesaid direction, this writ petition stands disposed of.
