The present writ petition has been filed for the following reliefs:-

(i) For issuance of an appropriate writ including the writ of mandamus, order or orders to the concerned StateRespondents to abstrain from oral threatening of cancellation of Mutation and any illegal encroachment over the land situated in Mauza- Inerba, Thana No. 91, Khesra No. 1791 (Area 60 decimal) and part of 1792 (Area-21 decimals from North) in Mauza Khajauli, Thana No. 92, Khesra No. 1 (Area 9 decimals) which is the registered purchased land of the petitioner no.1 and his father and its Mutation No. is 1097 and rent is paying continuously throughout collectively of 1 Bigha of land including the alleged land in question.

(ii) For issuance of appropriate order or direction to the concerned Respondent No.9, the Circle Officer, Khajauli to pay the adequate compensation

of the loss of sown crops over the alleged land in consequence of digging the land with machine for construction of Panchayat building without notice in presence of the Circle Officer, Khajauli, Respondent No.9 and Ex-Sarpanch and present Sarpanch Smt. Rina Devi of Inerba Panchayat, District Madhubani, in absence of the petitioners in the name of being it a government land based on the wrong map, without showing any official order and due process of issuance of notice to the petitioners.

(iii) For issuance of appropriate writ or direction upon the concerned Respondent No.9 who has not implemented the order of the revenue court dated 30.04.2009 relating to correct the wrong entry in the Revisional survey report and map even laps of about 16 years of passing the order and kept pending the representation of the petitioner since 24.07.2012 without action towards correctness of survey record.

(iv) For any other relief or reliefs to which the petitioners are found entitled far from the State Authorities.

Learned Counsel for the State raised preliminary

objection and submits that the writ petition has been filed based on an oral threat of cancellation, which is not permissible in law.

The question of adequate compensation shall arise only when the petitioner will sue before the competent Authority with proof that he is a Raiyat of the land.

In response thereof, Learned Counsel for the petitioners submits that the State Officials are continuously pursuing activities on their land under the assumption that it belongs to the Bihar Government.
